Wage Garnishment
(also called a "Wage Levy") is one of the most frequent
methods employed by the IRS to collect what is owed them, and it invariably puts a serious
roadblock in the financial life of a taxpayer - often without any
prior warning!
When a taxpayer has repeatedly failed to pay a tax obligation or has defaulted on a
Payment Plan, then a Notice of Intent to Levy goes out to
that taxpayer's employer, instructing them to withhold a portion of
their wages and pay those wages directly to the IRS instead. It
should be noted that the employer has no authority to refuse the
Wage Garnishment.
A Wage Levy can be particularly painful when a taxpayer is already
experiencing financial difficulties, and so sometimes just proving
hardship and Uncollectable Status is enough to have the
Garnishment released. More frequently, however, lifting a Wage Levy
requires entering into some kind of repayment agreement with the
IRS. For instance, if a taxpayer decides to file an Offer
in Compromise, then IRS Collection Action will be put on hold
while the taxpayer works out the details of the settlement.
